Terms of sale
These terms apply to every purchase you make from us, for an organisation or for yourself.
Some rules differ for consumers and business customers. Each section says when this is the case.
Who we are
The seller is the company that runs this website.
You can also reach us through the contact page.
Who these terms apply to
These terms apply to every sale of goods through Medical Baazar, whether you request a quote or order at checkout.
You are a consumer if you buy mainly for purposes outside your trade, business, craft or profession. Where the law of the country where you live defines a consumer more widely, that definition applies.
You are a business customer if you buy for your trade, business or profession. This includes hospitals, clinics, care homes and public bodies.
If you are a business customer, your own terms of purchase do not apply unless we agree to them in writing.
Quote requests and prices
Prices are given on request. A quote request is not an order. It does not bind you or us.
We reply to a quote request with a written offer by email. The offer states the products, the price, taxes, delivery costs and the payment and delivery terms. It also states how long the offer is valid.
If you are a consumer, the prices in the offer include VAT and any other taxes that the law requires to be included. The offer also shows import duties and taxes in the destination country, or states who pays them.
Where a product shows a price on the site and can be ordered at checkout, the price shown at checkout applies.
How the contract is formed
Through a quote
The contract is formed when you accept our written offer within its validity period, in the way the offer describes. We then confirm the order by email.
Before you send a quote request, you can review the products and quantities on the quote page and correct your details.
At checkout
When you click the order button at the end of checkout, you make a binding offer to buy the goods in your basket. Before that, you can check and correct every entry. We confirm receipt of your order by email. That email does not accept your order. The contract is formed when we accept the order by email or when we dispatch the goods.
Information for consumers
If you are a consumer, you receive the information the law requires for a distance contract before you accept an offer or place an order. This includes your right of withdrawal.
Keeping a copy
We send you the offer and the order confirmation by email. Please keep them with a copy of these terms. If you have an account, your orders are also listed in your account.
Payment
The offer or the checkout page states the payment methods and when payment is due. Payment is made in the currency stated there.
If you pay late, we may charge the interest and costs that the applicable law allows.
Delivery
The offer states the place and time of delivery and the delivery costs. It also says whether installation or assembly is included. The Shipping and delivery page explains how delivery works.
If you are a consumer and no delivery date is agreed, we deliver within the time the law sets.
Please check the goods when they arrive. If the packaging is damaged, note this on the carrier’s delivery receipt and tell us as soon as possible. If you are a consumer, this request does not affect your legal rights.
If you are a business customer, inspect the goods without undue delay after delivery and tell us in writing about any visible defect or missing item.
When risk passes to you
If you are a consumer, the risk of loss or damage passes to you when you, or a person you name other than the carrier, take physical possession of the goods. If you choose your own carrier and we did not offer that carrier, risk passes when we hand the goods to that carrier.
If you are a business customer, risk passes as the delivery terms in the offer state, for example under an Incoterms® rule. If the offer names no delivery term, risk passes when we hand the goods to the carrier or, if you collect them, when we tell you that they are ready for collection.
Ownership until payment for business customers
The goods remain our property until the price under the contract has been paid in full. Until then, you must not pledge the goods or transfer them as security. Tell us without delay if a third party seizes or claims them.
Your right to withdraw
If you are a consumer, you may have the right to withdraw from the contract without giving a reason. In the EU, the EEA and the UK, the withdrawal period is 14 days from the day you, or a person you name other than the carrier, take physical possession of the goods. If the goods arrive in several deliveries, the period runs from the last one.
The Returns and cancellation page sets out the rules for each region. It also explains how to withdraw and how refunds work.
Business customers have no statutory right of withdrawal. A business customer can return goods only if we agree to this in writing.
Products made to your specifications
Some models can be made to other dimensions or angles on request. The offer lists the specifications we will use. Please check them before you accept the offer, because the product is made exactly to them.
By law, goods made to a consumer’s specifications or clearly tailored to their personal needs are excluded from the right of withdrawal in the EU, the EEA, the UK and Türkiye. Your rights if the goods are defective still apply.
Defects and your legal rights
If you are a consumer, you have the legal rights for defective goods that apply where you live. These rights are free of charge and do not depend on any guarantee.
In the EU and the EEA, we are liable for any lack of conformity that exists at delivery and becomes apparent within at least two years. A defect that becomes apparent within one year of delivery is presumed to have existed at delivery, unless this is incompatible with the nature of the goods or of the defect. Some countries set longer periods. You can first ask for repair or replacement. If that is impossible or fails, or in other cases the law sets, you can ask for a price reduction or end the contract.
If you are a consumer in Türkiye, the section on consumers in Türkiye below sets out your rights.
If you are a business customer, the offer states the warranty terms. Where it does not, the law that governs the contract applies.
A commercial guarantee from us or from the manufacturer applies only where the offer or a guarantee document grants it. It applies in addition to your legal rights.
To report a defect, contact us through the contact page and give the product code and a short description. Photos help.
Our liability
We are liable without limitation:
- for intent and gross negligence
- for death or injury to body or health
- under product liability law
- where the law does not allow liability to be limited or excluded
In other cases, we are liable to business customers for slight negligence only where we breach an essential contractual obligation. This is an obligation that makes proper performance of the contract possible and on which you may rely. Our liability is then limited to the typical damage that was foreseeable when the contract was made. To the extent the law allows, we are not liable to business customers for indirect loss or lost profit.
If you are a consumer, nothing in these terms limits your rights under the consumer law of the country where you live.
Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control. Examples are natural disasters, war, epidemics, strikes, official orders and disruption at carriers or at the manufacturer. We tell you without delay and deliver as soon as the event ends. If the event lasts so long that waiting is no longer reasonable, either of us can end the contract for the affected goods. We then refund any payment for those goods.
Your personal data
We use your personal data to handle your quote request and your order. The Privacy policy explains how we process it and what rights you have.
Language of the contract
These terms are published in English, Arabic, German and Russian. The contract is concluded in the language of the written offer or, at checkout, in the language of the site version you use.
Applicable law and courts
These terms and every contract under them are governed by the law of , where we are registered.
If you are a consumer, this choice of law does not take away the protection that the mandatory rules of the country where you live give you.
If you are a consumer, you can bring proceedings in the courts where you live, where the law gives you that right. We can bring proceedings against you only where the law allows.
If you are a business customer, the courts at our registered office have jurisdiction. We may also bring proceedings at your registered office.
Complaints and dispute resolution
If something goes wrong, contact us first through the contact page. We try to find a solution with you.
The European Commission’s online dispute resolution platform was discontinued on 20 July 2025.
Changes to these terms
We may change these terms for future contracts. Each contract is governed by the terms in force on the day it is formed. The date at the end of this page shows when we last changed them.
Consumers in Türkiye
If you are a consumer living in Türkiye, the Law on Consumer Protection No. 6502 (6502 sayılı Tüketicinin Korunması Hakkında Kanun) and the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği, Official Gazette of 27 November 2014, No. 29188) also apply. Where they protect you more than the sections above, they prevail.
Information before the contract
Before you accept an offer or place an order, we give you the preliminary information that the Regulation requires, in writing or on a durable medium. It covers our identity and contact details, the main features of the goods, the total price including taxes, delivery costs, payment and delivery, your right of withdrawal and where you can apply in a dispute. You confirm that you have received it. This information forms part of the contract.
Withdrawal
You can withdraw from the contract within 14 days without giving a reason and without paying a penalty. The period starts on the day you, or a third party you name, receive the goods. When we hand the goods to the carrier, this does not count as delivery to you.
The law excludes some goods from withdrawal, for example goods made to your wishes or personal needs. The Returns and cancellation page explains how to withdraw and how refunds work.
Delivery and risk
We deliver within the time stated in the offer. For goods, this time cannot exceed 30 days from the day we receive your order, except for goods made to your wishes or personal needs. If we do not deliver on time, you can end the contract. We then refund all payments, including any delivery costs, within 14 days of receiving your notice, with statutory interest.
We are responsible for loss or damage until the goods are delivered to you or to a third party you name. If you ask for a carrier other than the one we chose, this responsibility ends when we hand the goods to that carrier.
Defective goods
If the goods are defective, you can choose to:
- end the contract and return the goods
- keep the goods and ask for a price reduction in proportion to the defect
- ask for free repair, unless it would cause excessive costs
- ask for replacement with an equivalent item without defects, where this is possible
We bear all costs of the remedy you choose. These rights expire two years after delivery, even if the defect appears later. This time limit does not apply if the defect was concealed through gross fault or fraud (Law No. 6502, Articles 11 and 12).
Complaints and disputes
Disputes below the monetary limit in force when you apply go to the consumer arbitration committee (tüketici hakem heyeti) where you live or where you made the purchase. For higher amounts, you can bring a claim before the consumer court (tüketici mahkemesi). Before you file the claim, you must first apply to a mediator, as Article 73/A of Law No. 6502 requires. You can file the claim at the consumer court where you live.
